What is the name of your state? What is the name of your state? NY

Hi I am posting on behalf of my sister. Recently she brought her car into the private dealership where she bought it from for a tuneup. Its a 91 Toyota Camry. They told her she needed to have the muffler replaced. She in turn told them to get the job done. The owner of the dealership "Mike", brought the car to Meineke mufflers to have the muffler replaced, and told them to call him when the work was done so he could pick up the car. They did the work, job done, and then had one of their employees drive the car back to the dealer as a favor I guess, so Mike wouldn't have to come and pick up the car himself. Mike does alot of his business with Meineke, so this was payback. Anyway, lo and behold, the guy from Meineke who was driving the car back gets into an accident. Meanwhile Mike calls up Meineke and asks what is taking so long, the car should have been done over an hour ago. Meineke telss Mike we have aproblem, there was an accident. To make a long story short, my sister, the owner of the car is being sued by the other party involved in the accident, because Meineke refuses to fess up and step forward and payfor the repairs on the other car. My sister is being drageed into all of this, having to go to court, etc etc etc, when she had nothing to do with this? What can and what shopuld she do? any help will be greatly appreciated!! Thanks for your time!!

Your sister needs to contact her insurance company asap. They will provide a lawyer to help, and will also go after whoever is responsible for the accident to pay the damages.

I'm sorry, her insurance company was notified and is aware of the situation. As a matter of fact, she went o court last night and a representative from her insurance company was there. The problem is Meineke. The other party is suing my sister as alast resort. She needs a release form from the counterparty otherwise she is stuck inthe middle , so to say, until Meineke fesses up and takes resposibilty.

The other party is correct to sue your sister since she's the owner of the car, and the holder of the insurance on it. It doesn't matter whether this is her fault. Her insurance company will go after Meineke to get any money back if they lose in court. Unfortunately, your sister doesn't have any recourse except to continue going to court until the case is settled.
