I was wondering how hard or how likely it is to be granted a court appointed mental evaluation of my soon to be ex?

I am in the divorce process. My ex resides in VA and has not been involved in my daughter's life even when we lived there. He voluntarily let me move to AR with our daughter this past December (he wrote a letter and had it notarized giving his consent). He has chosen not to see her until the beginning of this month (3 days, 2 hrs each day supervised visits). During each "visit", he refused to interact with her, stayed approx 20 ft behind her following like a lost puppy almost (visit took place at a mall play area). He never hugged her, never said "I missed you", the only thing he said to her was "how are you?" and asked to see her ear tubes she had placed at the end of April. She is only 17 months old and has a VERY limited vocabulary (dog, bye bye, night night, mama), so of course she never answered his few questions. He seemed very offended that she didnt answer these questions. That was the only time he showed any emotion whatsoever the entire 3 day visit. I'm a nurse and his body language/flat affect appearance struck me as really odd, he appeared almost like a stroke victim. I have no idea if he is currently taking anything medicine wise. It was just like he was physically there, but he was in another world. He only spoke when his mother asked him a question or specifically asked him to talk about activities in his life. There is a history of domestic violence (the reason me and my daughter moved this past December). He is giving my sole custody and not contesting that whatsoever, but he is requesting an outlandish visitation schedule that includes him wanting my daughter for 8 weeks back to back in the summer. I fear my daughter's safety!!! He left her in a locked car last September while going into a store (tempt that day was approx 90-95 degrees!), has made some derogatory comments towards her chest (i rather not mention on here what was said), has hit me while I was holding her when she was less than 2 months old. These are just a few of the things that make me fear for her safety if, by chance, he was granted the 8 weeks or any unsupervised visitation.

Also, can a court appoint a inspection or evaluation of his house in VA where he lives?
I wish I had taken pictures before we left and when I went back to get my car and belongings in February! He had converted the garage into a wood workshop, leaving 2 inch saw dust particles in the garage floor.This had apparently gotten into the air ducts, and when walking by certain vents saw dust was coming out! My daughter has a medical condition of her larynx that causes strider like breathing (most likely due to acid reflux, still in the process of figuring out the trigger, she is under the care of an ENT for this).

In the future, please append this sort of post to your existing thread - it makes it easier on the volunteers to not have to go digging for your history.

What proof do you have regarding his behavior? Although you're a nurse, you are not unbiased, nor are you capable of diagnosing him. If a judge DOES decide to order a mental evaluation, expect to undergo one yourself, as well.

There were several witnesses as the visitations took place at a public mall play area. I have their names and contact info, as well as one being a family friend. Unfortunately, there was no police record of his previous "acts" while my daughter and I were still living with him. I was too scared to make a paper trail at that time. I do have text messages (printed out) where he admitted he was "sorry for hitting you and all that other stuff I did to you and (daughters name)". I also have a small paper trail while we lived in VA when I finally contacted a women's shelter and they set me up with a lawyer. They also set me up with a counselor there which I was able to attend 5 sessions before my daughter and me left.

He has shown no interest in my daughter for the past 8 months, until he finally visited with his mother earlier this month.

I have absolutely no problem with undergoing a mental eval as well. I'm willing to do whatever is needed in the best interest of my child and for her safety/well being.

What type of proof would be needed?
