merchant credit card fraud, help!

What is the name of your state? Mississippi. I own a pack and ship business but I also have a website and take orders over the phone. I opened a merchant account about ten years ago with Discover/Novvus but the V/MC was transferred over to NPC about one year later. I took an order over the phone for about $7000.00 got the cc#, v-code, zip code, and shipped the merchandise. One week later, the card was reported stolen and my merchant wants the money back. I cannot afford to give the money back! It just helped me get out of past due debt. I want to open a new merchant account somewhere else with a new bank account. I realize they will sue me, but I don't care. I asked NPC for a copy of my contract but they say they don't have one, because I was originally set up with Discover/Novvus. Is it likely they will settle for a lesser amount to avoid lawsuit? Could I possibly win a lawsuit? Could V/MC take the money out of my new account, when I open one? Thank you for any advice you can give me!
