MI, Can't get downpayment back

MI-At the beginning of February, my husband and I put a $500 downpayment on a trailer. We signed an agreement with the sellers that included a provision which stated that the agreement was contigent upon our acceptance as residents of the mobile home park. The agreement also stated that the balance would be paid in full on or before Feb 22, 2002. We called the sellers on the 14th of Feb. and informed them that we were not accepted into the park. The seller said that it would take him a few weeks, but we would receive our downpayment back. It has now been over 2 months, and the sellers have been avoiding us. If we take this to small claims court, do we have a case?:confused:

Read the agreement over and make sure that you truly have the verbage you think you have. Then make sure you have proof of your escape clause in writting (that you weren't accepted into the mobile home organization. Try to contact the seller again (in writting) and give him an ultimatum to pay within 2 weeks.

If you still don't have payment by that time, then sounds like you have a case.
