Microsoft Refund dispute

Can somebody point me in the right direction -

I live in the UK, and I cancelled my subscription to xbox live, only for microsoft to take a further years payment £39.99, from my creditcard. I was unaware of this, and as i now longer used the creditcard in question did not make any minimum payment. The creditcard company have contacted me and have said I now owe them charges £39.99 + 79.89. I spoke to microsoft who comfirmed i had cancelled the subscription and would refund the £39.99 but not the charges.

Can they do this or are they trying their luck?

Any advice anyone can give would be greatly appreciated, i have tried to speak to microsoft, but they dont wont to know.

US Law Only - WHEN POSTING A QUESTION, YOU MUST INCLUDE THE NAME OF YOUR STATE

In the US, Microsoft is not liable for your failure to pay your credit card according to your agreements with the issuing bank. In the UK, who knows?

also, even though you didn't use this credit card, didn't you get bills/invoices whereby you could have paid or disputed the item in a timely manner?

Unfortunately Egg only deal online I had not used that particular account for about 9 months, but at least 5 times a week i would get an email offering me loans etc, so paid no attention after a whils - i just presumed they were trying to sell me something. The first letter they sent me was the first i knew about it.
