Military Divorce

What is the name of your state (only U.S. law)? KS
My husband left for deployment in February and soon after filed for divorce, I am a full-time student with two children. At the end of March he opened a new account and began only putting enough money in our joint account to pay bills, not enough to pay them and buy groceries. This has put us in a bad financial situation which has made it even more difficult to obtain legal counsel. He filed for an emergency divorce and I received paperwork on this matter Saturday. What, if anything, can be done?

Talk to his base commander. Military personnel are obligated to support their families.

You need to get a job. Depending on how much he is providing that may be all that his commander will require. If you want to postpone the hearing (to where is he deployed) then you need to file a continuance. Though you have had at least 4 months to get counsel. Why do you want to delay the inevitable?

Then he has no obligation to support the children. Are you collecting child support from their father(s)?

I agree with OG. You need to get a job. NOW. You've had months to be out looking. You may have to postpone your education for a while. Or find a job and go to school at nights.

As a military family member you are entitled to free legal advice at the legal office of any military base. That office will know what your rights and entitlements are and will assist in dealing with your spouse's direct chain of command. They will advise you of the minimum payment your spouse is required to pay you. I suggest you visit your nearest military legal office as soon as possible. I am not a legal professional but I am a retired military officer and this is the same advice I gave many family members when I was on active duty.
