Long story short, I was awarded an Army ROTC scholarship from the US Army Cadet Command and signed my contract with the Army last month. I had received my scholarship because I was granted a medical waiver from the Department of Defense Medical Examination Review Board (DODMERB) from a physical abnormality that I have.
My university's ROTC department is withholding the book money and stipend that I presumed I was entitled to because I do not look as if I am performing an Army push up according to standard, yet I was granted a waiver from DODMERB, they told me that they will not pay me or grant me the money that was a part of the scholarship until my next scheduled orthopedic appointment to basically get a "second opinion."
My family and I are suffering financially because we expected to receive reimbursement for books I had to purchase for college and also expecting I would be getting paid. I have also had to deal with the stress and emotional burdens of not knowing where my future will end up since upon receiving the scholarship, I stopped making back-up plans as this was my dream career.
Is it legal that a University ROTC department is withholding ROTC scholarship benefits and delaying the contracting period of a nationally awarded scholarship because they feel that my medical condition may create problems career wise although I was granted a waiver from an authority higher up in the chain of command?
There is other information that I have left out to make this explanation short but any opinions/advice would be appreciated.
