the father and mother have joint legal custody.. he left in january of last year n she took him from his home as soon as father left to kuwait. march 8, 2003, the new family has had no contact with son, he never called or answered any of the letters that was written by the kids and or his step mother. According to the step mother the step mother had no legal rights to him, however the child lived with her for three years, a gloried babysitter..

Husband and ex wife had a hearing today in regards to the modification of 12 year old son.. father has agreed to let son finish out his school year, the next hearing date is set for june of 2004, The master of the court asked husband who is an army resevist who has come back to the states if he will be deployed again. husband has just completed 20 years and can put in for his retirement. The bio mom, wants son until military career is expired which is in three years.. The father is not full time army.. and why does he have to choose between his career and his son, would we ask same thing of firefighters, doctors or lawyers or even teachers..

if it wasnt for the military we would not have these rights,

The biggest difference is that firefighters, doctors, lawyers, and teachers are seldom asked to drop everything and go overseas for 6 months to a year with maybe a week's notice.

When the father is deployed, the mother is the only one left in the states with any legal right to the child (thus, the only one left in the states who can do things like enroll him in school, authorize medical care, etc.) Whether or not the mother's petition to modify custody will depend on a number of factors, including the father's plans to stay in military and try for 25 or not, and his chances of being deployed again (pretty high these days).

husband told the master that he has twenty years in and that he is not willing or wanting to stay in the military longer.

the master did mentioned if me his new wife had partial custody, however there was a time when i brought david to the doctors for a physical,, that gave me permission to allow the child to be seen and treated...

another note, biomom wanted son to have his own room, we brought a house with four bedrooms,

Tell the master, whomever the hell that is, that this is legally false. YOU, as a stepmother, have absolutely no legal rights regarding that child.

If the child is with you and breaks an arm, is injured to the point of needing immediate life-saving surgery, or other medical procedures, YOU cannot legally give permission for anything.

Corset, unless the biological mother gives up her parental rights, you will never have custody of the child, partial or not. As for medical care, it's one thing to take your stepson to the doctor for routine care (heck, I do it all the time with my stepson), but if something serious were to happen, you would not be allowed to check the boy into the hospital, or authorize any serious or emergency medical care.

Your husband has decided to retire with 20 years, and that will be a strong point in his favor if the mother files for modification of custody.
