What is the name of your state? California

If the state awarded a portion my military retirement to my ex as community property, how is the retirement then considered income. How can it be both?

If the state awarded a portion my military retirement to my ex as community property, how is the retirement then considered income. How can it be both?
Were you married for at least 10 years of your military duty? If so, the government can issue her share of the payment directly to her so that its taxed to her directly. Otherwise, you would have to ask the divorce court to order that her share is net of tax so that the tax you have to pay comes out of her share.
