I live in California. I retired from the Military in 1993 after 20 years. During this I was married for 11 of those years. During the divorce she was awarded a percent of my retirement pay. The amount was awarded on my pay as of Jan 2000. The divorce was final in July of 2000. In Jan 2001 we were given a Cost of Living Allowance. Her lawyer insists that the portion of my retirement should be increased by the amount of my increase. Since the increase was after our date of divorce and the fact that we will be receiving an increase each year I disagree. The court awarded her a set amount of $89.75 and did not state anything about future Cost of Living increases/ The question is----Is she due this increase or future increase.

I'm no lawyer but from what I read If the court awarded her a set amount then that is all she will receive. check out militarydivorceonline.com and see a lawyer who knows this stuuf.
