What is the name of your state? wisconsin my mother recently passed away with 25,000 in credit card bills. the house is appraised at 70,000 by the city for property tax reasons. it is in disrepair. there is less than a 1000 in her accounts. can my sister and i pay these bills and avoid probate court. can we try to discount these credit card fees that my mother owes. no ones lives in the house at this time. heating oil has been bought. furnace maintenance ect. can we probate ourselves. how much should we look to pay a probate att if we are not confident in our abilities. we dont care if this gets tied up for ever but we dont want to loose this house (low in value as it is). there is no will. i never thought about the taxes. if the house isworth less than appraisal, that might lessen that burden if any. the more i right the more i think i need an att.

Check with the probate division of the court house where your mother resided and inquire about probating a small estate and/or family administration. Each state has different limits of whether or not an attorney is required. Barnes and Noble has good how to do your own probate books. If you do not feel comfortable doing this yourself, if you are able to do so, then by all means do hire an attorney. To handle your mother's final affairs, you or your sister need to apply to the court to be the administrator of your mother's estate.
