What is the name of your state (only U.S. law)?
California.

My 12 year old daughter was called in to the Vice Principal's office today on suspicion of cheating on a keyboarding test. She did not cheat, the whole thing was a misunderstanding, and school officials are now satisfied that nothing wrong happened.

My issue is that she was called in to the office about 2 hours before the end of the school day. She said she wanted to call home, and the VP told her she could not call me. When she was released to the teacher, the VP instructed the teacher not to let my daughter call home. My daughter attends a private school, and I cannot find anything about this in the student handbook.

Is this legal? I want to find out the law before I go to the principal about this. I appreciate any advice you can give, I have google searched and cannot find any references.

Thank you very much.

Why would the school be required to allow a minor to use their phone? It wasn't an emergency. If it was, they could call you directly.

There is no law which would compel the school to allow your child to contact you via phone during an investigative action.

If the cheating was found to be "a misunderstanding," maybe your daughter had a misunderstanding of the VP's instructions. 12 year olds may not have been privy to the entire conversation, and 12 year old girls can have a dramatic streak at times....

I give the vice-principal credit for giving your daughter the benefit of the doubt and having a private conversation with her instead of blowing it out of proportion. Your showing up could have brought in all kinds of drama.

In all probabiility, you would have been called to come to school had it been a clear case of cheating.
