minor son taking all the blame

My son, 17 yrs old, and a friend snuck into our neighbors mobilehome and "played house". They cut the screen to get in. They cooked some food, watched the tv, and made approx. $800 worth of phone calls. They traced him by some of the phone calls.
My son has never been into any trouble before, but the "friend" has had priors.
The sherrif came to my home at 9:30 at night and made me wake him up to question him. He admitted to what he had done and the sherrif arrested him with a felony into our custody. They told him not to talk to the friend because they were going to question him in the morning.
They lowered the charge to a misdemeaner because our neighbor wrote a letter to be easy on him.

Twice I asked my lawyer if the other boy was charged with anything. He said that would be a different matter and that he wouldn't or couldn't pursue anything. The probation officer said that if he had been charged that his hearing would have been at the same time as my son's and that my lawyer was the one to pursue this. I am confused.

I have now read the police report which says that they weren't going to pursue the friend and didn't charge him with anything. My son has now admitted to the charges against him and I am told that beings he did this that he has to take the whole rap and there was nothing we could do about it.

I can prove that he was involved but probation says that now it's too late.

Is there anything we can do about this? I do want to see my son punished for this, but it's not fair that he should be the only one to pay the restitution.

The police report also stated that they recorded our conversation in my home without telling us. Is this legal?

Please, I need some serious advice.
