What is the name of your state (only U.S. law)? Kentucky/Missouri

I have the potential for an interesting issue coming up this summer.

Background:
I have full phys/legal custody of all 4 kids. I live in Kentucky, dad lives in Missouri. Oldest son will turn 16 in July.

The two states have vastly different laws when it comes to when a teen can get their license. Missouri (dad's residence): Permit at 15, restricted license at 16.... Kentucky (mom's residence): Permit at 16 with proof of passing; good grades in school and Junior status, restricted license after 180 hours of driving with permit and taking a mandatory driving class.

The requirements to get the permit in Missouri are the normal birth certificate, etc., along with proof of resindency. Because the child does not receive any bills, dad can use his bills to prove proof of residency. The paperwork requirements are the same in Kentucky with the exception of proof of passing.

With the kids going to their dad's for the summer I am a little worried that dad may try to take kiddo to get his permit and license while he is there. I am just wondering if there are any laws that would prevent him from doing this?

If kiddo DOES get license, then simply have him convert it to the license applicable in your state when he returns. That's the law anyway, since it's his residency.

Dad is going to do what Dad wants to do on his time. You, however don't have to allow the child to drive on your time.;)

First of all, that's not EXACTLY how it works. Missouri has a Graduated License Program. The steps are:

STEP ONE: Instruction Permit
Eligible Age: 15
Valid for: 0-12 Months

To Obtain:
You must pass the vision, road sign, and written tests.
A qualified person must accompany you to the license office to sign a permission statement.

Permit Notes:
Under age 16, you may drive only when accompanied in the front seat by a licensed driver who is:
a qualified person (meaning a PARENT);
a grandparent;
a qualified driving instructor;
a qualified driver at least 25 years of age who has been licensed for a minimum of 3 years and has received written permission from the parent or legal guardian; or
a qualified driver designated by the disabled parent or guardian of the permit holder.


STEP TWO: Intermediate License
Eligible Age: 16 to 18
Valid for: 0-2 Years

To Obtain:
You must hold the instruction permit for at least 182 days (beginning the day after issuance).
You may not have any alcohol-related offenses in the last 12 months and no traffic convictions in the last 6 months.
A qualified person or grandparent must accompany you to the license office to verify you have received 40 hours of driving instruction, including a minimum of 10 hours of nighttime driving instruction between sunset and sunrise.
You must pass the vision, road sign, and written tests if previous results are more than one year old.
You must pass the driving test.



So, YES, Dad COULD take Junior to get his PERMIT, while the kids are in MO for the summer. But it's not like Junior is gonna (legally) be out driving around and getting up to all kinds of crazy Shenanigans. Junior will NOT be getting his LICENSE in MO.
