MIP Alabama detained and everything please help!!!

Im 16 and 2 nights ago i was charged with MIP of alcohol. I was in the car (not driving) and there were open containers of alcohol in the car. I was asked to step out of the car i did no problem they searched the car. After that i was cuffed, searched then put in the car. my rights were not read to me, then i was taken to the police station. I was not allowed to see my mother who was at the station and the officer called my mother from my phone. The sergeant was sitting next to me as well as 2 other cops in the room and one of them said "why dont you just let this go and let him go with his mother" who was at the station at the time and asked to see me. after that i was cuffed again and taken to a juevenile (spelling?) detention center. it was about 4 am at this point. I was at first put in a bunk outside the other kids pods and then i was placed in an isolation chamber until 6 am that night. my parents were not allowed to see me and while they said they checked on me every 15 minutes only once did a man come talk to me and that was to offer me lunch. My parents were 2 hours early and they would not release me.

On top of all this it was my 1st offense. I have never been in trouble with the law EVER before.

anything here seem wrong? or was this all protocol?

It's probably perfectly legal.

I don't know about the deep south, but that's certainly a little unusual in most areas. That makes me think that there was more involved - perhaps you or someone was was stinking drunk. Or you or someone else was abusive to the police. Or something like that.

What the police did was very likely entirely legal.

Why did the police stop the vehicle? It appears they had probable cause to search the car. You consented to a search of your person. You were arrested. You were processed.

Juvie is not the Holiday Inn. Perhaps if your parents hired a lawyer you may have gotten out a little sooner.

We don't know the whole story, but the bottom line is, nothing good happens after midnight. Didn't your mother tell you that?

the main thing was the officers did not let my mother see me. at the station or in the detention center. she was at both places and wouldn't allow her to see me.

it wasnt my car i wasnt driving we got in the turn lane my friend took his eyes of the road and hit the curb and came to a stop.

They did not ask to search the car and they did not tell me i was under arrest.

Neither of us were drunk and we both stood by the car while they searched us then hand cuffed us.

overall lesson learned it just seems like they skipped on a few things that we thought were required. like my mom being able to see me.

Oh Brady... What really is your question.

Lawyer on stand by? So what?

Mommy can't see you? So what?

Friend hit curb and car came to a stop= probable cause for the police to stop.

Open containers in clear view= probable cause for a legal search- no need to ask.

Drunk or not= doesn't matter. You had alcohol in your possession. You're lucky that's all they charged you with. If your friend didn't get charged with anything else, he's one lucky boy.

Now, I hope you understand this is a very serious situation. You can face a fine from $25.00 to $100.00, or 30 days in juvenile hall.

On the bright side, you may be able to get this dismissed if you attend alcohol classes.

Mom and dad need to get that lawyer off stand by and see if he can work something out with the prosecutor.

You didn't need to see mommy when you were out with your friends late at night ovviously doing things a 16-year old shouldn't be doing, right:rolleyes:

I've told my daughters over and over again ~ "If you ever get in trouble and I get a phone call from the police, make yourself at home. I will take my sweet time getting to you, in fact I'd probably stop for a mani and pedi on the way. Behave like a thug, get rewarded like a thug. Mommy out."

I think it is hilarious that you were out drinking with your buddies and then get all angry because you are treated like a criminal.

You apparently thought you were grown up enough to go out drinking.... but get angry when you can't see mommy.

Miranda isn't in question. Stop watching so much Law and Order.

Listen to your lawyer, lose the attitude and you might do okay.

Still going to cost your parents over a grand, though.
