Misleading Internet Usage with Cell Phones

My issue is that I recently signed up for T-Mobile's internet (20$ a month) service with my black berry. On my blackberry I was able to assess the internet, view and write emails, and also use their AOL IM service. When I got my bill I found that every time that I had used my IM service I was charged 10cents per each message. When I signed up for the service the customer service representative did not explain to me that accessing AOL IM via the blackberry option and accessing it via their web browsers were two different services. When I spoke with customer service to inform them that I had been mislead since when you use the internet via your computer and additional charge is not added for your AOL IM service they would not take off the additional charges. I find this to be misleading and unethical because they do not once explain when you sign up for their internet service that there are two different options for AOL instant messaging nor do they explain that the AOL IM service that is available on your phone is completely separate, electronically speaking, from your browser services. Is this worthy for a lawsuit?

Not to me it isn't.

Especially since the T-Mobile website is pretty clear:
"BlackBerry Internet Service Plans
Integrate up to 10 of your existing e-mail accounts and have your messages pushed right to your BlackBerry handheld. Choose a data-only plan with unlimited e-mail and Web browsing, or choose one of our bundled Minutes & Mail plans to add tons of Whenever Minutes®. to these great data features."

Doesn't say ANYTHING about 'free' text messages.

AOL IM is not a text messaging service it's a service that is typically used via the internet as opposed to the actually "text messaging" service that your phone provides. The phone does differentiate between a "text messaging" service and an aol IM service.

Who cares?? Where does it say ANYTHING on the TMobile plan that IM (Instant Messaging) is included with their EMAIL and INTERNET plan???

If you can find it, then go to court.
If you can't, then pay it.

Seems pretty damn simple to me.

I suggest you review the fine print on your contract. The representative ( sales associate) is not responsible for explaining everything. You however, are responsible for the terms that you agree to (you know...that paper you signed.)

Do you even read what you sign?

And JETX was not rude...just honest. If you can't handle it..then leave!

Hmmm that's actually weird to be honest with you. I'm with T-mobile and have a Sidekick2. I have the unlim internet/text messaging package just like the one to Blackberry's unlim package(only diff is the corporate email ability). I use Aol and Yahoo IM and do not get charged extra. What exactly are you doing?

This is the mesage that I see when I go to the t-mobile website:

How many text messages do I get with this plan?

With any BlackBerry data plan, you get 300 free inbound and outbound messages a month. After that, it is only $0.10 a message. If your device supports instant messaging, you can also send and receive instant messages.
 
Oh I see. Well I had my Sk2 since 12/04 so I may be grandfathered into this unlim plan I have. I don't see the same being offered right now
