Misleading Applicants?

What is the name of your state? Virginia

Can a employer make false claims in description on a Job Posting on a State VEC Website in order to attract the best possible candidates for a start up company, then offer the applicants some lesser deal in hopes that there desperate enough to accept it? Basically they advertise a full time position with a huge hourly pay. When you contact them, its commission percentage work based on your solicitation skills, and order volume. You have to be available for the 40 hours a week, but you only get paid a commission if there’s work based on the invoice amount billed the customer. Not described on the posting.

Unfortunately I fell for one of these hoaxes, even signed a non-compete based on verbal promises that never came true.What is the name of your state?What is the name of your state?

Yes, as long as the actual particulars of the position and pay structure are adequately explained at the time a job offer is made. If false promises are knowingly made in order to induce a candidate to accept the job and the employee suffers damages as a result, then the individual may have the basis for a civil claim.

How does the State Employment Commission view the use of there service as a Venus Fly Trap? The posted job does not even exist.
