Question 1: If a person makes a contract with the intent never to follow through with the terms of the contract and does so with knowledge that they will benefit, is this considered misrepresentation (fraud)?
Question 2: Assuming there was intent to induce another to reply on the mispresenation and that there was justifable reliance by the deceived party, would the requirement of 'misrepresenation of the facts or condition with knowledge that they are false or with reckless disregard for the truth' be met if the person made a contract with the intent never to follow through with the terms of the contract and ultimately benefit from it?
That last question is a complicated one to understand. Hope someone understands it.
