i live in california..

ok..i have a somewhat detailed situation..but i will try to be as brief and to the point as possible.

about 8 months ago i was charged with a drunk in public charge which was initially tried as a dui.

i did not get the dui due to the fact i was not actually driving...however, the prosecution decided that since i was drunk and near my car with the bac level of .35% that i had to take the 6 month program..even as a first offender.

ok.. so i began my classes for the 6 week program.. finished those, and then went on to start the 6 month program...however, they make you wait 3 weeks between these 2 programs apparently...

well, on the 4th week, i forgot about my class and ended up missing it :/ .. when i called to explain that i had missed it they informed me that if i have missed 4 weeks of going to the program.. and that i had to go back to court..

when...in all reality i missed 1 week? *shrug* it seemed messed up to me...
at this time i began to form a medical condition as well. It prevents me from being able to get a deep breath as well as chest pains sometimes so severe i can barely walk around..

so combined with the overwhelmingness of this and also since i was not even driving any longer i decided i would just ignore it all.
stupid. i know...
so i never called to make a court date
and here i am 6 months later i have a bench warrant sent to me in the mail..

i have been trying to get medical help here... but i have been unable to.. and see this leads me to my situation...
my family has no money they can help me with for my medical situation..none at all..however...i have a close friend who recently moved to the phillipines this last year and she runs a medical clinic out there and apparently has been able to do amazing things for even terminally ill people with nutritional related treatments combined with various other natural methods..
she has offered me a fully paid flight out there and a place to stay at,,... and i also have a close friend who lives in finland who i had been planning on going to stay with... perhaps indefinitely/

.... but... i dont have my passport renewed recently... nor do i have a *visa* of any sort...and now i have a bench warrant.

is there any way i can get my papers in order and leave this country??

if never coming back is one possibility i would still consider leaving... i do not wish to live the rest of my life out in hopeless bull$hit not even knowing what is killing me from the inside.. and if i could stay with people who really care about me and want to help me... and could possibly save my life... that is worth more than anything to me.
Even if it means giving up on ever being allowed back here in this corrupt nation.

so my question basically is... is there any way i can still get a passport and / or visa with a bench warrant for something as petty as missing a dui class? :/

or perhaps just a passport maybe? if being an illegal immigrant without a valid visa in finland was a requirement for me to leave, i would still consider that as well...i have a job set up for me there under the table. I just want to know whether i will be able to leave... i am sure customs is alot more serious now since 9/11 and all...

also...if i do HAVE to somehow take care of this first... is there any way i can call a public defender and try to set up a court date without having to go through the long jail process? i had to do that once before..and with my condition it would be really hard on me. :/

any help ideas anyone could offer is greatly appreciated

Let's see: you didn't follow the terms of your probation because you forgot and besides they were petty anyway. Now you want to go to see some quacks in Asia.

Hey, I'd try that on the judge. I'll bet he's never heard a story like this before!

(I've only heard the story myself about 300 times.)

It's unlikely you can leave the country. When you try to get a VISA, a background check will most likely be done, and the warrant will get you declined.

I have 2 DUI's and I've followed my probation requirements. I never hear from my PO, the court, or anything. Consequently, I get my license back in 2 1/2 months.

If you were going to have trouble getting to your treaments, why didn't you contact your treatment director and work something out??

Dont' know what you tell you on this one.

okay... so i cant get a visa most likely... can i get a passport do you think?? i could at least just leave with that...

and be a refugee fleeing america to better places illegally staying there : ): )

or could i possibly call and make an appointment to go to court? without having to go through the fukt up jail process?? i mean it is nothing more than a waste of your tax dollars and my bull$hit.. to have to go through the jail system.

and as for quack in asia...well she is from here and has a md from the us.. she just is filipino. See why i think this place is stupid? americans believe they know everything..i hate this place..where i really want to end up is finland.. where i know a beautiful girl that loves me more than life itself....

if i was to say... marry her? could i possibly get citizenship in finland?

i just dont want to have to spend the rest of my short time left dealing with bull$hit here in this retarded ass place... bull$hit that i wouldnt even have to be dealing with if i was $rich$ enough to hire a lawyer.

is that so wrong?

or do you need both a passport AND a visa to just leave the country?? i really do not know the details of any of this....i researched some into visas and found that you can legally stay in many countries with just a passport for up to 3 months or so...

?

The issue is getting through customs and immigration. If the country you're going to does background checks at customs, you're dead.

Leaving the country is really bad idea. If you're charged with something and try to leave the country, that makes you a fugitive. It will catch up with you and you'll get deported back to the US and be in a lot bigger trouble than you are now.

Take ownership of your mistakes, and faces the consequences. The sooner the consequences get started, the sooner the consequences will be over.

okok so im thinking in a fantasy world of impossibility i guess... *sigh* ... the thing that is really sucking about all this is on the bench warrant (which is issued by the sheriffs office and not the court..)
it says that i cannot call on behalf of this warrant..and that i am to just go down there and pay off the rest of my fines for $650.00

since i have this medical condition (of which i have more tests coming up later in the week for from a free clinic...) and absolutely no income or family with any income that can help me pay this..or get a lawyer and such....

am i correct in assuming they want to arrest me... spend the night in jail.... wake up.... get errained in court the next day...and then get released again? just to repeat the process all over?

this is so retarded... i cant make money here... i have no ability to work and just started the application process to attempt to get on welfare a few weeks ago... i need to get medical help and or a diagnosis at least to just understand wtf it is exactly that is wrong with me... so i can know what to do for the rest of my life..

i just tried calling the public defender and spoke with one about my case... he described to me that since this bench warrant is issued by the sheriffs office that i have to talk to them about it and the public defenders office cannot intervene without an order from the court...
i guess the only question then i can ask... is....

what do you suggest i do?? i obviously have to take care of this.... going to jail is going to be hell on me in my condition... but i guess it is the only option i have? to just turn myself in??? ... but then what will happen?? i will still have this condition.. once i get out of jail and once my probation becomes reinstated.... am i just doomed? to suffer the rest of my life here? without an ability to leave? constantly going back and forth from jail on an issue that has no ability to be resolved????

what happens to people like me???
do they just die?
i mean..wtf...i really dont see why i cant just leave... :/

Well, I used to think work would kill me, but it hasn't happened yet ...
And I know not working doesn't kill, either.
Thus, we don't die.

And I think we see eye to eye on this: No leaving the country...
Ok, then.

A bench warrant means they will not actively look for you,
no cops will come to your door, you are being asked to turn yourself in.
But, they will arrest you the next time you get pulled over or
get in trouble with the law, then it comes back on you.

Thus I do recommend you go see the sheriff, maybe take some money,
the full amount would help or whatever you got, and take the warrant,
who knows?
I do not know what will happen, you may do a little time
but jail is less likely if you face the music.
If you do not go and you ignore the bench warrant,
you may do more time and jail time is more likely.

hint: be nice. cooperate.
oh yeah, don't mention leaving the country :)

What will happen?
If I were the judge, maybe I lock you up figuring the county
gets paid X-dollars/year per each inmate in jail, that's the best way
for you to be productive and think about what you done.
Or maybe you're nice to me, and I like you, and the guy in front of you
is so arrogant and rude towards me, and since you're a really nice guy,
I throw that man in jail and tell you:
Ok sir, it is unfortunate but our jail is full and you only broke a minor
law when you did not finish the program, and then you turned yourself
in which is commendable. So I'm going to forgive you the jail sentence
and since you are making payments I'm not going to punish you with fines
and will give you a second, final chance this time you need to finish the
program, if you mess up one more time, boeeee ...

BLAM, next!

Well I dunno, you dunno, who knows?

Maybe get a public defendant ... yah.
