missing information in a police report

my son put his dad's pickup in a ditch when he went to pass a pickup pulling a horse trailer. The trailer's signal's were flashing right and he started passing, in a legal passing zone, on the left. he saw the trailer turning into him and he avoided being hit, but slid into a ditch. The horse trailer's signals were wired backwards and the other driver told the investigating officer that he had not realized it, but now knew they were wrong. the accident report states absolutely nothing about the incorrect wiring and only says that my son was passing incorrectly. when i asked the officer about the missing information he told me it had nothing at all to do with the accident, that my son should have known by the speed of the pickup and trailer that something was going to happen. He ignored the fact that the signals were flashing right and there was adequate room on the right shoulder for the truck to have pulled on to. We live in Colorado and it seems that technically my son did nothing wrong and technically pulling a vehicle with incorrectly wired lights is wrong. no tickets were issued. The missing information on the accident report gave our insurance no recourse but to hold us responsible. Any suggestions?
