What is the name of your state (only U.S. law)? Louisiana
I am a resident of Louisiana, but I live in a very rural area w/in a couple minutes of the Mississippi state line.
Several weeks ago, an "incident" occurred with a friend's boyfriend. The boyfriend's name is "Glynn", and he lives in Pike County, MS, for the purposes of this post (easier ti explain that way since several people are involved in the explanation). My friend, "Fran" (for the purposes of this post) had dated Glynn for 2 years, and my kids and their mother and stepfather were friends of Glynn and Fran and they had known Glynn for the same amount of time...they all approved of him very much.
A couple weeks ago, Glynn had occasion to be with my 11 y/o daughter in the presence of no one but a very elderly woman lacking cognition...in essence, Glynn was alone w/ my 11 y/o for about 20 minutes. On the way home, my daughetr started crying and said that "Mr. Glynn had scared her", and she recited the events for us...she can repeat surprisingly long discussions verbatim, so we got it all. Long story short, he did not have any contact with her, but he used some VERY OBVIOUS and UNDOUBTEDLY PREDATORY conversation with her. As sick as it makes me feel to say this, he was no doubt attempting to groom her as a potential future victim. The conversation was riddled with sexual innuendo and he spoke in lengths of how he could tell that she "could really keep a secret, especially from mom and dad". That *******. That, and more, but no contact whatsoever, and it was interrupted early on. It could have been worse, so much worse.
So, he hauls his pervert ass back to MS while he still could, and I went to work to "check him out" via online resources, then the county courthouse. Surprise surprise, the guy is carry a 2006 Two (2) count indictment for "touching a child under 16 with the hand or other part of the body for sexual and lustful pleasure (or something real similar). All I can say now is that he camouflaged very well. A quick talk with...or talk TO...the ADA on site produced no comment from the ADA, and rightkly so...he stated that he "couldn't say anything" because he was the ADA trying the matter, set for trial in "a couple of weeks".
Since that point, I have tried and exhausted nearly every local resource to find out one very simple thing...his pendant court date on the indictment, which I have a copy of. MANY phone calls and one email direct to the clerk later, I have gotten nothing but a huge runaround in one very simple query, specifically, "What is the court date?". The most I have gotten from anyone there in MANY tries is the defendant's lawyer's name and phone number, and statements saying that I must contact him for the date.
Now, EVERY contact was extremely civil, and they knew nothing more than that I wanted to know the court date. I was, surprisingly to me, asked why I wanted the info, and the most I said was that I had an interest in it because of a problem here in Louisiana with the guy and my daughter...a generic reply, and I added that "she had not been 'harmed'", so I have no idea why they would want to keep the court date "a secret", becauzse.
The final point was when I clearly and very specifically asked if the pendant court date was in fact public record, and the clear reply was "No". I know Louisiana is different from every other state as far as it's legal system is concerned, but fo rthe life of me I can't get my mond wrapped around a non-public record court docket. But, I simply don't know if that's true or not!
I realize that this was quite a long post with some info that wasn't relevant to the query, and I could have simply asked "Are pendant criminal court dates public info or not?", but I wanted to set the foundation for my question to pre-empt any foreseeable questions for crequest9s) for clarification.
So, let me do it right here: Are these pendant criminal court dates public info, and if they are, who should I call next for assistance? Straight to the MS AG? I am worried that the trial date will pass w/o my knowledge, and I want to view the proceedings, so I son't enjoy the luxury of the time required for a "certfied/RRR letter campaign" for every individual or entity that can possibly assist me here.
