What is the name of your state (only U.S. law)? Missouri St. Charles County.

Does anyone have or know where to get a copy of a motion to prevent relocation and affidavit to stop my Ex from moving with our daughter to Florida.

I have checked with the clerk of the courts and they do not have one, and I have called several law firms and they want a full retainer and representation.
Can one one help???
::EDIT::

Or is a motion to modify custody enough to stay her move and comply with the 30 day response time?

Regards,

I received the certified letter delivery notice last night. I will be leaving early to get it from my post off.

There have been some views but no responses, please respond if you have any thing that might help.

There isn't really a "form", per se. Rather, as long as you follow the format of a motion, and title it "Motion to Prevent Relocation of Children", include your case #, etc, you're ok.

This is a link to the Missouri pro se site, which has available motions, but not specifically for relocation prevention.

thank you, it's not very clear and they should have some examples to follow. Maybe I missed them on the site.

Does any one from MO have an example they are willing to share from their paperwork? - redacted of course.

Thanks,
David W.

I typed out a ridiculously long response to you, and the forum ate it.

The short version is:

Is there a CURRENT COURT ORDER for custody and residence for the child?

If the answer to that question is no, you have no basis to attempt to prevent the relocation.

If the answer is yes, here are some more links to help you:

http://www.mobar.org/esq/jul8/RELOCATION%20FINAL-FAMILY%20LAW%20CONFERENCE%20-%20Chrisman.pdf

http://www.mobarcle.org/cle/2015/stepping-up-stepping-out/pages/day-two/Freed/10%20PDL%20Motion%20-%2010%20(00917382).pdf

I'll post more later. However, please understand that I'm posting from the standpoint of a parent who has successfully moved within Missouri 3 times, blocked my ex's relocation within the state, and ultimately successfully moved across the country with my children. If you cannot even find the above information using the Google, you probably NEED an attorney, but should feel free to ask questions here, of course.

..

Does anyone know what happens if the other party fails to file their response with the court in the 14 day time frame?

I've successfully served a Motion to Prevent relocation to my ex and have waited over the 14 days for them to file a response and request a hearing through the court.

What happens now?

You need to start your own thread. When you do remember to name the state you are in.

This thread is over three years old. Please check the date of the thread before posting...if it's older than 4/6 weeks with no new posting from the original poster, don't post.

If you wish to get information from a particular member contact them by private message rather that dig up a dead thread.

Also, as a FYI, CJane hasn't been to this site in almost a year and a half.
