i live in st. petersburg fl and have owned my my mobile home for 4 years without complaintfrom mngmt or the park owner... recently my sisters childeren have been placed with me legally . the park owner has decided to refuse to allow them to stay with me even though it is a family park and other childeren reside here that are of the same age . he has threatened to evict me if i keep the kids in the park. i have never signed a lease agreement with the park and need to know what if any legal rights i have to stay in my homewith the kids.

What is your thinking? You should have gotten a written fixed lease prior to getting the children. Since you are on a m/m lease, you AND the children can get booted out.

well thank you for that sarcastic reply but it doesnt help me with knowing what if any rights i may have or how i could appeal any eviction process so unless the forthcoming advice is more constructive and less admonishing i would appreciate you not getting more involved.

Hello.....you DO NOT have any rights as a tenant on a fixed lease because you DO NOT have a fixed lease or a written lease for that matter. Therefore you are legally a month to month tenant. Thus, Landlord can give you 30 days notice to vacate and you have absolutely no defense. But what about the kids, you may ask? Yes, the notice to vacate applies to the kids to. Is there discrimination here? No.
Now if you had a fixed lease you would have been sitting in the catbird seat even if the childrens names were not listed on the written lease. Why? Because of the Federal Fair Housing Law that states that a property owner can not discriminate due to familial status. If you became legal guardians of the children, Federal Law would have protected you from eviction but only if you had a lease. Because you have no lease, the Florida State Statutes are applicable.

2966- You might check HUD's web site, this guy who replied to you is in a catonic state. That was my firsty clue that his advice might not be on the up and up. The advice that he and a person called judge something or other gave me was for crap. I think they are both rich, greedy,republican, landlords, afraid to do whats right be others. Because if they did they wouldn't get more than their share. Dang I just noticed this was in 2001, well you never now.Good luck, and don't believe everything they tell you. Also should be free legal advice in your area, charge based on income.
