My response:

Well, first of all, if there's a custody / visitation order, you can't just "change" it merely because there's a "disagreement." There must be a "change in circumstances" and the change MUST be in the "best interests of the child." A disagreement about "who gets Bobby on Arbor Day", just won't cut it.

Unless you can prove these factors, it would be a waste of time and your money. I would strongly suggest that you obtain a free consultation with a local Family Law attorney. Most will talk to you to answer a question or two for free. Call one tomorrow.
