exwife clamming 19 year old daughter is living with her ,when actually not for over year daughter doesnt want to get involved. she lives with boy friend,I belive they plan to split the money.how old does the child have to be when not entitled to Child Support in NY? I might add that for the past 51/2 mthI,ve been giving my daughter at least 20-50 dollars a week till she could get on her feet. I also bought her a 1700 dollar car to get to school with. Just last month I also got her a 200 prom dress. I have a court order to pay a weekly amount plus half of babysitting fees for my son. Upon getting a better job I agreed with my ex to pay an additional $50 a week for my son. I feel that I should not have to pay my ex for my 19 yr. old since she does not support her in any way.

In New York child support is payable until child is 21, unless the child is emancipated, in this case it appears to be the case.

Yes, but this is the problem. How can I prove to the court that she isn't living with her mother? My ex submitted income tax forms claiming she lived with her. She received earned income credit also on this. I have recently turned this in to the IRS, but am not sure when investigation will take place. How do I convince the court that I am right? The last court date, she lied through her teeth on this same matter, and still the Court believed her, because I had no proof.
