Modifying Child Support

What is the name of your state? Oregon

I have a few questions for anyone who may be able to help me. I would like to modify the court ordered amount of child support that I am currently receiving. I recently just settled my case for visitation and custody but in the State of Oregon child support and visitation are two seperate issues therefore are never all just handled at once. I know that the other parent is making a more significant amount of money then before and our son is just now starting to attend daycare. My question is this: In order to modify the amount the division of child support told me I need to prove the other parents income increase. How do I go about being able to prove that? In our court depostion he had stated the amount of money he was making which was twice as higher then before. Do I need a paystub of his? I am just curious as to how to be able to prove that. Any info you may have to offer me would greatly be appreciated.

How long has it been since the CS order was entered or modified?

Was daycare cost included in the order? If not and enough time has passed you may be able to file for a modification based on the child care. Once you've filed the papers and he's been served he'll be required to provide you and the court with his recent paystubs.

As requested by Gracie 3787, when was the CS order entered into? If it has been some time & the amount of child support you are receiving is not adequate to meet child's needs, you can ask the court for an increase & they will pursue his income. Sometimes, it is believed as a child gets older the cost of raising him/her increases & also the cost of living increases as time goes by. . . . for these reasons (among others) child support is sometimes increased.

How long has it been since the order was signed? Oregon has a 2 year wait on filing for a modification, unless you can prove a sugnificant change in circumstance. That is of course if you are using DCS. But it is actually pretty easy to file for a court hearing before a judge. I did this last August. Used an attorney and after it was all said and done, I truly think I should have done it myself. The judge asked my ex and I questions. My attorney hardly said anything at all. Then made a ruling. Before the hearing my attorney subpoenaed my ex's work records from his employer. I am actually not sure how DCS does things. I am in the process of asking them to do a modification for me right now. I will be finding out shortly.
