modifying existing divorce contract

My husbands ex wife wants to re-open the divorce contract so my husband is obligated to pay for health insurance and college. He has recently been diagnosed with a cronic condition and she feels my husband should pay for all medications and health insurance and college. The divorce contracts reads both parties will do what they can to off set the cost of college and until he is 24 my husband will cover his insurance.

Is this a viable case? It would help if she had a job to help off set some of the costs too. Not to mention she gets a healthy monthly check each month for child support and allimony.

Any thoughts?What is the name of your state (only U.S. law)?

Tell Dad to speak with an attorney; if his child is disabled he may well be paying child support (in one way or another) for a long time to come.

Assuming you're in the US.

WOW! My uncle was a childhood diabetic, with major health issues. He got through college and medical school without a penny of help from his parents toward tuition, health care or medication.

What sort of "Chronic condition" makes kiddo not only unable to contribute toward his own college, but also makes MOM unable to?

Cronic condition - Narcolepsy

Thanks to everyone with replies. The cronic condition is Narcolepsy. The divorce contract reads that for college both parents will do what they can, and of course, we will more and likely contribute from a 1/3 to 1/2 depending on performance in school.

The cronic condition, same would apply, we wouldn't expect him to cover his medical expenses all through school or once he is emancipated, but I strongly feel it should not be all pit on our sholders.

We have contacted an attorney, it seems so simple but we are dealing with lack of rational and high emotions.
