I have been fighting with landlord for 8 months to repair wall and floor in master bedroom due to almost monthly flooding. (ground level) I paid to have a professional carpet cleaner come out , he laughed because there was nothing holding carpet down. It has all rotted away, and he told and showed me all the mold in capet, walls, etc. I have made numerous complaints (in writing) to the complex and have written corporate office. There has been no resolution to leak. I have cancer and I have been going through therapys, and major surguries in these 8 months. I cannot even go into the room and due to physical condition I cannot lift more than 10 pounds, so my belongings continue to be destroyed. Needless to say I have alot of hospital and doctors bills so I cannot afford to have someone do it for me. My renters insurance tells me they cannot be held responsible because the damage is due to landlords negligence. Who can I turn to? What can I ask for? I have been paying rent this whole time because i need a place to sleep (my couch). Any advice would be appreciated. thank you.

Check local listings for affordable legal advice because mold can cause fatalities. I would also suggest speaking with someone where you are being treated for cancer...a social worker...or someone who can assist you in reporting this problem and also check to see how the mold may have assisted in deterioriating your health.

Get out of there immediately!!! You are no safer in your living room, then you are in your room. Mold that is not cleaned properly produce spores that are airborne, and if you have the mold condition that you say you do it sounds like your past the point of general cleaning. Your entire apartment is infected. I am going through the same problem right now, I have been evacuated from my apartment by an inspection company. (see my post "Mold Damage to property) Call your local health department, file a complaint & get out!! Deal with the legalities of it later. Picking up and leaving wasn't easy, I am living w/family & friends right now, but I have a 5 mt. old & my husband is a insulin dependent diabetic both high risk for mold related illnesses. Please, whatever you do..get out of that place right away!!

I can't imagine what type of legal advice is going to provide you with the immediate funds you need to leave. You are perfectly within your rights to do so, it sounds as if you home is uninhabitable. If you don't have anyone to take you in, until you can get the situation remedied, then I would suggest you contact your local Red Cross. They should be able to provide you with emergency housing.

finally

after numerous attempts I finally got a response from LL they want to put me up in another apartment and furnish it until my problem is repaired in my apartment. Is this an admission of guilt? What if anything should i require in writing? Alot of my personal belongings have been damaged and my bed and bedding have been destroyed, even when the leak is repaired i dont want to get screwed in the long run.
