Lived in residence going on 5 years now. Complained of many issues, & smells since move in. After withholding rent due to being robbed via entry through an unlocking back door he never fixed, & getting into dispute with landlord where eviction was filed, health inspector was called, & repairs were made, a year has gone by. I have made one more written complaint since the repairs were addressed by the contractor calling my home yelling at me. They repaired a few of the items but left the smell unaddressed. I have since made another complaint about ceiling sinking, wet, cracked foundation, visible mold, & a leak in the fireplace (can hear drip, drip drip, when it rains). The gutters are also horribly backed up & spill over with just a normal amount of Ohio rainfall. This was addressed by contractor doing a walk through..... nothing since.
Currently: As the weather has grown warmer each day, the musty smell has become stronger & stronger. We have a 2month old son who has definite breathing problems when at home & not elsewhere. Also, our five year old was extremely sick every winter (months couped up inside continuously) & slightly sick last winter. I have had an extreme exhaustion problem for a year now & extreme headaches (can be tracked by dr. visit where no problems could be found). My lungs over the last 2 weeks are constantly tight & I have felt as if i have a cold off & on for at least that long. Due to the 2 mos old I can't claim my wifes exhaustion is from the same mold problem, but she is wonderful & lets me sleep. ( i do help when i hear him)
As I have read more in the last two days I am extremely concerned with my 2 mos olds health situation, dr. saw him last week & he was completely fine, that night same breathing problems. I do not have the $ upfront to move out now but feel this is what we have to do. I am afraid the places i am trying to get into will refuse application due to his eviction filing last year. Also, my son is already signed up for school & there is only one other apartment located in the area. What steps do i take to insure (as much as possible) when all is said & done we come out of this compensated for the downfall we are about to take (moving with no $ saved & loss of all our belongings since i am sure the place is consumed in mold).
Lastly, is it legal for him to charge 1 tenant $700 while charging others $599 for the same apartment?
