Mold/rented Townhome

Lived in residence going on 5 years now. Complained of many issues, & smells since move in. After withholding rent due to being robbed via entry through an unlocking back door he never fixed, & getting into dispute with landlord where eviction was filed, health inspector was called, & repairs were made, a year has gone by. I have made one more written complaint since the repairs were addressed by the contractor calling my home yelling at me. They repaired a few of the items but left the smell unaddressed. I have since made another complaint about ceiling sinking, wet, cracked foundation, visible mold, & a leak in the fireplace (can hear drip, drip drip, when it rains). The gutters are also horribly backed up & spill over with just a normal amount of Ohio rainfall. This was addressed by contractor doing a walk through..... nothing since.

Currently: As the weather has grown warmer each day, the musty smell has become stronger & stronger. We have a 2month old son who has definite breathing problems when at home & not elsewhere. Also, our five year old was extremely sick every winter (months couped up inside continuously) & slightly sick last winter. I have had an extreme exhaustion problem for a year now & extreme headaches (can be tracked by dr. visit where no problems could be found). My lungs over the last 2 weeks are constantly tight & I have felt as if i have a cold off & on for at least that long. Due to the 2 mos old I can't claim my wifes exhaustion is from the same mold problem, but she is wonderful & lets me sleep. ( i do help when i hear him)

As I have read more in the last two days I am extremely concerned with my 2 mos olds health situation, dr. saw him last week & he was completely fine, that night same breathing problems. I do not have the $ upfront to move out now but feel this is what we have to do. I am afraid the places i am trying to get into will refuse application due to his eviction filing last year. Also, my son is already signed up for school & there is only one other apartment located in the area. What steps do i take to insure (as much as possible) when all is said & done we come out of this compensated for the downfall we are about to take (moving with no $ saved & loss of all our belongings since i am sure the place is consumed in mold).
Lastly, is it legal for him to charge 1 tenant $700 while charging others $599 for the same apartment?

Since you were being evicted anyway, you should have moved. You said that you withheld rent, so you should have used that to move. You've been there 5 years, but you haven't moved. Then you knowingly get pregnant, have a child, and complain that where you live makes your child sick. It costs money to raise a child. You could have taken that money and moved.

You do not know much about eviction do you? First, I don't want to live with an eviction on my record. So i fought it & won. Second, I would have still owed him that money. So your advice is not valid. Lastly, the health inspector was involved in the inspection & cleanup of the previous issue. Sorry, but i expected him to be competent.

I guess you get what you pay for is true as ever on this free advice board.

Let me also add, i did spend money trying to move... with a letter from my lawyer, pictures of the situation, copies of letters I had sent the landlord.... even with those in hand I was still refused a new lease by three companies who were all very well aware of the situation as i was upfront & honest about it. They each said it would not be a problem, then took my deposit & app fee, then proceeded to turn me down due to bad rep from my landlord....

You do not know much about eviction do you? First, I don't want to live with an eviction on my record. So i fought it & won. Second, I would have still owed him that money. So your advice is not valid. Lastly, the health inspector was involved in the inspection & cleanup of the previous issue. Sorry, but i expected him to be competent.

Let me also add, i did spend money trying to move... with a letter from my lawyer, pictures of the situation, copies of letters I had sent the landlord.... even with those in hand I was still refused a new lease by three companies who were all very well aware of the situation as i was upfront & honest about it. They each said it would not be a problem, then took my deposit & app fee, then proceeded to turn me down due to bad rep from my landlord....

I understand that rent was still due. I understand that you would had to have a new security deposit, while waiting on the old one to be returned. All of the information that you just added was NOT in your original post. I can only comment based on the information that you provide. Get it, smarty?

It appears that YOU may have been the cause of not being able to move. YOu also gave those people reason to NOT want to rent to you. They probably thought you would be an annoying tenant. If you had not been so up front about your current situation, they may have rented to you. You stated that

From this I assumed that the eviction was on your credit report already. Then you wrote (in a separate post)

You've renewed your lease 4 times. You chose to do that. Then you come here complaining about your health and the health of your children, and ask about compensation. You also chose to pay more money than you thought was fair. And then you ask for compensation. What percentage of responsibility do you accept in this ordeal?

The fact i still live there shows the eviction didn't go through.

My responsibilities are pay rent, report problems, keep the place in the condition I moved into it in. That's the renters responsibility. That's the beauty of renting. I pay rent when things are fixed. I have always reported problems, in writing & verbal. When they were not fixed & I began to have a health concern I called in the health inspector. had i sat on my hands this whole time & done nothing i could understand your 'advice' of what i should have done back when & how this is now may fault. I did not. I got people who are supposed to be specialists involved & was told all was good. That is not my fault they were wrong & the problem is back. i am unsure how you people see it this way.
