What is the name of your state (only U.S. law)? wisconsin
i rented a home from a coworker whom knowingly knew i had a fire and lost everything and was using my last dime to move and whom knowingly knew my wife had lupus and asthma,whom knowingly knew the home had a mold problem but forgot to tell us.my wife has been ill since we moved in and now im becoming ill.can i sue her for health,monies paid to her and medical and time off work?also what type attorney do i use?

And you knowingly know that this is actually mold (as opposed to mildew which many folks mistake for mold) and one of the few strains of toxic mold...how?

You used your last dime to move into the house. How are you planning to pay rent?

Tenants are required to mitigate damages just as LLs are required to minimize their losses. To prevent and remedy additional health issues a move-out and notice to vacate are in order. It would seem that you are not insured based upon the information in the post. (It is not clear whether tenant is a former property owner or former renter.) To address your question, anyone can sue for anything… whether the law will allow you to prevail is another matter. The primary issue is with the rental not the mold secondarily associated with the rental. A tenant always has the option to vacate and terminate based upon a proven lease violation.

Ihave a job and have paid my rent every month,but it takes alot more than a months worth of rent to relocate i cant afford to move again.I have had mold test done and have spoken to my lanlord about it several times she plans to do nothing because she unemployed and cant afford it i have witnesses that she knew the mold was there when she rented us the home.my question is do i have a case

Ok, you have what you think is a toxic mold problem of unknown quantity that may or may not be producing spores. Both you ad your wife have allergies or hypersensitivity to mold. You have known for quite some time that the house, may or may not be making you ill, but have elected to continue living there. You don’t have money to move, but you have money to spend on an attorney. Your LL can cowardly give in to whatever demand you feel would make your day, or he can choose to fight you and make it as expensive as possible for you to continue in your lawsuit.

that would come out of the mouth of only a landlord trying to take advantage of their tenantes thats why you cant put your real name because noone would rent from you.

No, that would (you hope) come out of the mouth of a friend who helped you out when you needed help and nobody would come to your aid. But, your co-worker is not trained to identify bottom-feeders.

Black toxic mold...in Wisconsin. Which lab? Didn't the biologist send you a pamphlet...or some kind of advice?

It strikes me that the question you pose in your original post is of a lawsuit. But there is no mention of notice, liability or neglect...and most importantly, that you need to vacate yesterday...at any cost!!! Unbelievable: literally. Black mold and you can't afford to move, but you want to know your chances of a lawsuit? Simply unbelievable. I thought we had better breeding here in WI...and I'm not referring to bacteria.:rolleyes:

Yes; I am quite aware that mildew is a form of mold, caused by bacteria.

The fear of mold seems to have become the newest issue for not only getting out of a lease but getting compensated for such.

If the OP is so concerned about what this might be doing to both he and his wife, his first step is vacating the environment, THEN worrying about compensation.
