Molested his Step Daughters and may get away with it !!!

My daughters (22 & 20) have recently come forward and told me that their step-father (my ex-husband) had molested them repeatedly from the ages of 12-15.

I encouraged the girls to go the police and file a written report and they did. We then found out that my ex had done the same thing to one of my daughters girlfriends when she was about the age of 14 and she came forward and gave a verbal/written statement too. We now have three little innocent girls who this creep has violated!!! The detective assigned to the case did a complete investigation, HRS is involved, polygraphs have been administered to both my daughters(which they both got 9+ on) as well as all three written/verbal testimonys. When my ex was scheduled to give his statement and take a polygraph (which he has been saying he would do all along....) he walked in to the meeting with a lawyer and told the detective to go and *%#@ himself. He was not giving a statement OR taking a polygraph. I was called in to give a verbal statement with I did. When all was said and done, the detective was quite frank with us and said the State had a great case and they would be prosecuting my ex to the "fullest for Sexual Battery and Sexual Molestation against a minor". We just found out last week that the case may never go anywhere after all because of a Florida Statute of Limitations on Sexual Battery/Molestation. That is OUTRAGEOUS!!! My ex commits sexual battery/molests my daughters and there is a Statute of Limitations on that???? Please help me here... what can I do????

Unfortunately statutes of limitation serve a useful societal purpose (they create finality and keep matters from being open forever, while memories change, witnesses' memories and presence -- even defense witnesses -- are not available, etc. )

You may want to make sure the staute of limitations is as short as he says.

But, apart from castrating the guy -- which would be a crime if you did it -- there is one more thing you can do. The girls can sue him civilly for actual and punitive fddamages -- and the damages can't be discharged in bankruptcy -- as typically the civil statutes of limitation "toll" or do not run during the child's minority. That won't send him to jail but will cost him a bundle and give him the representation he deserves in the community!
