My friend's Mother passed away in April 2005 with Pancreatic Cancer. She had a Will, but before she passed away, she had a quick deed done in order to put my friend and her sister's name on her house.
Her Mother stated in her Will that she wanted her daughter (my friend ) to move into her house after she dies. Is her house protected against any creditors?
Her Mom's house had been paid for, but she found out that her Mom had taken out a 2nd Mortgage on her house. My friend and her sister's name are listed on the house now and my friend has taken over the house payments, but... the Loan is still in her mother's name. Is this okay? What does she have to do, so she and the house is protected?
[I]Also,[/I] my friend was joint on her Mother's bank accounts. After she passed away, she had her Mother's name removed. Can creditors or credit card companies have access to that money? There really isn't much, but she just needs to know her rights.
Does she have to start a probate if there's not really any assets? What kind of assests would qualify for Probate? She had an old car, but not worth too much. What is the max amount for Michigan?

My friend is having a difficult time trying to understand all that is going on. She has 2 Credit card companies calling and harrassing her about her Mother's bill. She has told them her name was listed on the house beforeshe passed away, but they continue to call to harrass her. She's still grieving the death of her Mother and these creditors are calling her almost everyday. It's very overwhelming for her. She just needs to know her rights and what to tell the credit card companies. She has already sent them the copy of her Mom's death certificate. :confused:
