I am trying to gain physical custody of my daughter (LONG story). Right now I have a temporary order which gives me visitation every weekend, until the custody evaluation is complete. Anyway, one saturday my daughter was at my house visiting and she fell on her arm while playing (she is 9). I looked at her arm, no swelling or bruising, and gave her ice. On Monday, her mom took her to the ER, called me and told me that our daughter had broken her elbow. I FELT AWFUL!!! She seemd to understand that kids fall and get hurt, no big deal. 3 weeks later we got into an argument. She called her attorney and claimed that I had "refused" medical treatment when our daughter had broke her arm. Recently, I obtained medical records which clearly state "no evidence of a fracture". My attorney now has these records (he is aware of the allegation, since her attrny called him) We go back to court in about a month, among A LOT of other evidence that I have, what usually happens when a parent makes a false allegation like this? My attorney is def. gonna bring this up, I am just curious if anyone has dealt with something like this before. Thanks!
