my husband bought a ring 7/00 from shaw's jewelry store. it cracked six mths later. we had it replaced. it cracked again after month or so. the stone fell out. it was replaced. another stone fell out. it is now feb. i have had the ring replaced 4 or 5 times. i asked for my money back and they say no, because it has been over 90 days. since the original purchase. do i have any recourse? they offer to exchange however i am tired of getting mdse. i want to go to another store. thank you. slt

Cracked ring

When you purchase an item from a merchant, such as a jeweler, there is an implied warranty of merchantability. That means the article must do what it is supposed to do. The ring did not; therefore, it could be a breach of that warranty. However, the length of time the warrantee lasts depends on the circumstances. 6 months might be too long. However, they did replace the ring, and the warranty of merchantability would apply to the replacements. It sounds like those cracked in a shorter period of time, so you might have a good argument that the replacements breached the warranty.

However, all this is not definite. I could not say for sure how you would do in small claims court with this. So I suggest either continuing to take replacements as bad as that option is, or perhaps hire an attorney to write a letter to them for you.
