How do I start the process of collecting a debt that is more than $3500? I do know that I can not go through Small Claims and I have to file a form in which the fee is $190. What is the form called?

What is the process?

Please help!

Thank you for the response. I did search this website before posting my question.

Unless I mis-read the info, small claim are for damages less than $3500. I am looking for info for money damages exceeding $3500.

Please help!

What are the total amounts of the damages you are seeking ?

If it's not too much more than the jurisdictional limit of $3,500.00, it may be more cost effective and quicker for you to "remit" to the maximum of $3,500.00 in Small Claims court, rather than fighting a long, drawn out, battle in a court of greater jurisdiction.

I believe that the $190.00 you are talking about is the court's Filing Fee for a standard Summons and Complaint filing. You might do well by buying a book on Litigation in your local, and larger, bookstore from their "Legal" section if you are intent on going this route.

My response:

Well, you haven't told me the issues or facts of your case, or the type of case that it is - - e.g., personal injury, auto accident, contract case, or something else. Nor, have you informed me of your educational and legal background. So, taking these considerations into account, it will be a personal decision on your part.

However, I can tell you this. At $8,000.00, you're definately in a "Limbo" area - - i.e., it's too much for Small Claims court, but by hiring an attorney you're going to be paying about 1/3 or more of the amount to an attorney anyway. Either way, you're going to lose a big chunk of money.

So, if you want to try this yourself, it is always better to be forearmed and forwarned. Therefore, buy a litigation "How To" book, and read it. If it's something you can understand, you might be able to do this yourself. If not, then your only choices are as outlined above. But, at least with the book, you'll be better equipped to make that final decision.
