Money Woes

What is the name of your state? New Mexico

Okay, what happened is this. I lent someone $200 cash and a verbal agreement was made to pay me back in three days. It's been a over a month that I've been asking for payment but now I just get the four letter word as payment. So, I have emails where they ask for the money and where they said they would pay me back in three days. I don't know if that can be used in court? They have a criminal record while mine is clean as a whistle. Now, do I have a chance of winning if I take this person to small claims court for my $200? Please let me know what you think so I can proceed with a course of action on this matter. Many thanks to all.

PS I did learn my lesson :mad: Hey, they sounded sincere and honest. Isn't someone's word worth gold anymore.. guess not.What is the name of your state?

Thanks. I know I could try it but I guess I'd like to know if I'd have a 'good' chance of winning . If I don't have a chance then I'll just spend my court costs on gasoline. I have no experience in the outcome of these kind of cases so any insight is greatly appreciated. Thanks.

My response:

I haven't seen your documentation, and I don't have a crystal ball to make predictions. But from what you've posted, it appears you have a better-than-even chance of prevailing. Court costs in Small Claims court are "pocket change."

If you win, your court costs; e.g., the filing fee, will be added to your judgment, including statutory interest from the date of the judgment.

Do text messages from a cell phone hold up in court? The messages were sent to my email address so I have hard copies of them.

MY RESPONSE: No. Losing time from work is not compensiable in this type of matter. If you lose money from work, that is the price you pay for exercising your constitutional rights to seek redress through the court.

MY RESPONSE: The rules of evidence are very relaxed in Small Claims court. So, your evidence should be admissible without worry or concern. You're welcome.

Good luck in court. I don't see a problem in winning, but in collecting. I won in small claims court about 8 yrs ago and have gotten nothing.

The chances are great that they will not even show up in court. In that case, you would win by default. Unfortunately, "boilrman" is right. Small claims court only says, "You won and the money is due you". They do not collect for you. If the B party does not then pay voluntarily, you have to file for garnishments, etc. Good Luck.
