Colorado. I had given some engagement earrings to a girl and 1 year later SHE calls off the wedding. Since that time (2+ years)
she has said 1) sent them back 2)I did find them 3) I want to give them back personally 4) I will send them in the mail, since I don't want to see you.
She did try to send them and the USPS made a mistake and sent them back 2 days later. After this I tried to contact her for them back and no response. Now after another 6 months she has finally replied "the earrings are gone"
As I understand it, the Co. law is that if the bride breaks off the wedding, than the groom is entitled to the engagement "gift" back.
do you think I have a good case in bringing this to small claims for the earrings (if still around) or in money for the price of the earrings?

I doubt that you would have any success in court. The problem is that 'earrings' are not engagement items, but are gifts. As such, I doubt that any court would recognize your claim that they were indeed 'conditional contract' items of the marriage promise.

But, heck, its small claims so anything could happen!!
BTW, you can only sue for monetary damages in small claims... not for return of the property.
