Several days ago (March 7th) I notified my landlord that I was giving my 30 day notice. I have an apartment waiting for me on April 1st. The landlord originally said that they would want me out by the 1st of April so they could re-rent, which I agreed to.

However today upon coming home, the landlord spoke with their spouse the co-landlord, and said I have to pay next months rent. Now my question is with a month to month lease do I have to give 30 days starting at the beginning of the month? Can't I simply pay for the 1st week of April since that will end the 30 days, so in essence, 1/4 of the rent.

My lease says Month to Month and states The tenant agrees to give at lease 30 days' notice of their intent to vacate the premises. If this notice is not given the tenant will be responsible for rent for the premises for this period of time, such amount to be deducted from the security deposit.

Whats my legal ground here?

You have NONE.......you did not give a FULL 30 days, YOU owe for next months rent if they cannot find someone to rent it on April 1st.

Not many people start a lease in the middle of the month!

Just think you would be just as pisssssed if after paying the rent on the 1st the landlord ,he gave you notice on the 7th. that he wanted to evict you by the 30th

The rule of law here is : The landlord is entitled NOT to lose even ONE DAY'S rent over you, so who pays for the other 3 weeks in april?

PS.......you want your security back? Well tell the landlord YOU will pay for the ad in the newspaper, and YOU will help the landlord show the apartment to prospective tenants, yes allow them to look at your apartment while you are living there, and hopefully someone will sign a lease for April 1st, and the lanlord will have to give you back your security since he has lost NO RENT!

If he refuses then you write him a letter stating he cannot use the security for aprils rent since he has NOT made a good faith effort to re rent, and you expect a FULL refund within 14 days or you will sue him in small claims court.
