I have an interesting question that i hope someone can answer for me. I have been living in an apartment for a little over a year now. Up until a few months ago, i was on a lease. As of the beginning of the year i have been renting month to month. I recently spoke with the office and they are explaining to me that i must give them a written notice of me moving 45 days prior to me actually moving out. What is the point of going month to month if this is the case??? I have never signed any contract stating that i am going month to month, so am i liable for this 45 days if they are not able to rent my apartment? Doesn't make any sense to me. I am closing on a house in a couple of weeks and just wanted pro-rated for those days. and they gave me this excuse of the 45 day notice. Can anyone help me at all?? Thanks in advance and look forward to hearing some good news.

tell them they are wrong, unless the landlord gives you a wriiten notice that you have to give 45 days notice to move, then the old terms of the lease continue on a monthto month basis...so if the lease says 30 days then its 30days.

This sounds like a scumbag landlord trick so they wont give you back your security deposit, untill you sue them in court.

1. The point of month-to-month is that you can terminate your lease (albeit with notice) at the end of any month. Both you and the LL get that privledge. Would you like to have your month-to-month tenancy terminated at the end of a month without notice?

2. You probably didnt have to sign a month-to-month agreement, your lease probably turnied into one after your lease expired, you didn't leave and the landlord agreed by accepting rent from you. The month-to-month agreement that it turned into probably carries with it all the conditions of the lease, except the term.

3. You are probably liable for the appropriate notice period, either according to the lease, ot according to local law, whether it is 30 days or 45 days or whatever.

4. You may have to begin the notice period on the beginning of a month.

5. The scumbag landlord says to check the local laws.
