I have a question my mother was living in a rental house. She lived on this property for 6 years she signed a one year lease when she first moved in. after the year was over the landlord never asked her to sign another. The house was old and had a lot of problems the landlord recently stopped fixing things as they would break. the house also had the old fuse boxes and did not have a fire alarm, the windows are sealed shut and cannot even be opened , we had asked for this to be fixed but never was. After the kitchen sink would not stop running and dripping , She notified the landlady she wanted the sink fixed but she would not send anyone out to do it . Fed up my mom found another place to live after several attemps of trying to reach her on the phone to notify her she was moving ( she even left a message on her voice mail ) she sent a letter informing the land lady she had left the property . the land lady recieved it on the 7th of the month and is now demanding my mother pays her for the entire months rent. My mother was served with papers today to go to court for the amount of the rent plus damages done to the property. the night of the day my mother had movers moving her out the house was broken into my mother had bags of trash setting there she was going to put out the night before trash came so dogs would not tear into it . The bags of trash were shredded all over the house a huge hole was put in the wall and the door was broken through and bolt lock busted from this , my mother filed a police report at that time . The officer even told my mother the house was not up to code and someone of her age should not be living in that house. Is my mom responsable for those damages even after she filed a police report?? Also should she have to pay the entire months rent if she is month to month? after your lease is up and you are not asked to sign another does that make you month to month?? Sorry this is so long.
