Moocher in public housing.

My 53 year old cousin is moderately mentally retarded. He lived with his father for his entire life. They had a two bedroom apartment in subsidized housing for the elderly and disabled.

Last summer, my uncle passed away. My cousin will be able to keep his two bedroom apartment until a one bedroom opens up in the same complex.

All of a sudden he has a new friend, who has moved in with him. The friend applied to live in the apartment but was denied because he, is not disabled, has no income and has a previous eviction on his record.

Recently, my cousin called me and asked for a ride for both of them from this guy's old apartment to the subsidized place. I was out of town and couldn't comply.

Since my cousin is hard to understand, I had to speak to his friend. It seems the friend had to move out of his apartment and had no place to go.

To cut to the chase, this was two months ago and Mr. Moocher has been living in the subsidized place all this time. This has been verified by my other cousin.

My main concern is that my cousin might get evicted for having an unauthorized person living with him.

How can I rectify this situation?

There is no guardianship on my cousin.

Not much of anything you can do at all . If your cousin is not making good choices talk to him and see if he really understands this other guy could be the cause of him getting evicted. Also speak to your county social services to learn what would have to happen to become his legal guardian and to learn the legal obligations that would go with it.

I agree that you should contact social services; ask for "adult protective services" or its equivalent in your area. These are the people that work with the frail elderly and other vulnerable adults, and their services are free. Now that his dad is gone, your cousin might need additional support in order to live independently. Adult protective services might furnish referrals to local programs that can help.

Having an unauthorized person in the unit is a violation of the public housing lease and will lead to eviction. If your cousin is evicted for cause, he could be disqualified from other forms of assisted housing in the future. If you haven't already done so, make sure that a family member is listed as an authorized representative with the housing authority. This person should get copies of all notices and should be notified of any issues.

I agree on contacting " Adult Protective Services " .

Hopefully ,If Public Housing hasn't given permission for this person to stay there , the authorities ( Adult protectives ) , ( a housing Rep.) with the help of the local police ( if necessary ) in removing the unauthorized person, without eviction of the disabled person .
