I have a problem, fellas. My lease ends Jan 31, but my landlord is saying that I have to give 60 days written notice of my intent to vacate, meaning rent is due through March 11.

Question #1 - In Georgia (Dekalb County, Atlanta), is a landlord legally allowed to require more than thirty days written notice? My lease says 60 days (which I signed to), but I have heard it said that they cannot legally require more than 30.

Question #2 - My lease says "Either party may terminate this agreement at the end of the initial term by giving the other 60 days written notice prior to the end of the term." Well more than 60 days prior to Jan 31, we were delivered a note from the management that said we had until a certain date to renew (don't remember the date, but was about 2 months ago). Does this not constitute written notice by either party?

well when was the exact date the letter was sent and when was the last day of the notice.....

hmmmmmm losing papers ....

If you are that careless then get a safe deposit box, so you can move out on Jan 31st with no penalties.

You will have to sue the landlord in small claims court BEFORE they sue you, in order to get your security deposit back, make sure you take lots of pictures to show a judge, there was no damage.

So the first week of February, file a small claims action against the landlord.
