Thought I would answer what you didnt know. Thank you for answering my question on the overtime in North Carolina. My job title was Roofing Superintendent. I started with this company March 1998 finished October 1998. They insisted I work the hours I did. Some weeks believe it or not I worked 100+ hours. Please advise if I have a chance collecting additional wages and if yes who I should contact. Thank You, Randy Ward

Sounds like you might be considered exempt as an executive employee. If you supervised two or more employees and regularly exercised independent discretion in your work, you are likely exempt under the FLSA. However, some states have additional protections for employees, and I do not know about North Carolina's laws. I would advise you to check with your department of labor about state and federal overtime. Good luck!

In addition, you should move quickly. Since willfulness by an employer is difficult to prove, it is likely that you would only be entitled to overtime falling within two years of the date you file a lawsuit, if you are entitled to overtime. As of today, any overtime accruing prior to 6/22/98 would likely be gone.
