What is the name of your state? TX

I just got a letter from Morgan and Associates out of Oklahoma City for a $911 debt collection notice on my Foleys account that was just recently turned over to them.

The letter states "Attorneys & Counselors at Law" at the top and is signed "name" "Attorney at Law"

I don't recall ever getting a notice of debt from a "real" lawyer.

Does anyone have experience with the CA or dealings straight with a Lawyer..or is this BS?

Should I NOT validate? The SOL has not passed, its very recent. I want to send validation, but don't want them to sue me or send a judgement.

Someone help....any advice appreciated
 


Not absolutely sure...

I'm not absolutely sure, but I've found lots of references via google for "Morgan & Associates" in Oklahoma. Looks to me like they are a law firm engaged in the practice of debt collection. So, if what you got was a standard "this is an attempt to collect a debt" letter, treat them as a collection agency. The fact that they're a law firm doesn't relieve them of the FDCPA.

Yea they are out of Oklahoma..

Just curious though, as Attorneys, do they sue or collect as a collection agency would?

They can't sue you from OK. They would have to hire a TX attorney in your area to do that. I would certainly treat them as a collection agency. They all think 'law office' on letterhead scares the crap out of everyone, but when you know the truth of what they do, they're not all THAT scary any more. Its unlikely they'd sue over $900, especially since TX is a very debtor friendly state. Its not impossible, they like to try to scare money out of people first.

What if I did receive a judgement or get sued for the balance of my Foleys account, I have no idea even what a judgement is. Does this just bascially mean I wouldn't be able to buy anything until I paid, or would they garnish my wages for it?

I'm going send them Validation today, well see if they respond.
