Back in 1999, my condo management co was putting my fees to the wrong unit # thus making my account late. They insist they were sending me certified documents which I never signed for. As they assumed I was 'ignoring' them, they had their lawyer send me a letter (which I did get by cert mail)...this cost them $300 which they want me to pay (even though they admit their posting mistake). I have copies of all cancelled checks. I have repeatedly sent letters stating I did not owe this fee as they made the mistake. Well, in June of 2001 the lawyer sent me a summons to put a lien on my house, a copy went to my mortgage co. Unbeknownst to me, my mortgage co PAID them $1900 out of my escrow account without contacting me first, I knew nothing about this until my mortgage payment increased by $250/month. Their legal department can't help me because they "lost my file", great! By making this payment, the mortgage co denied me my right to finally appear in court with the condo management company. Now I will have to sue in small claims court but who do I sue for the $1900? The bank was negligent for taking my escrow $$ but the management company messed up in the first place! Thanks!
