Mortgage Co. Didn't Pay Taxes

What is the name of your state? Indiana

My brother-in-law recently found out that his mortgage company had failed to pay his property taxes (something about the mortgage company having another company take care the escrow payouts and then getting it back again). So far he's been unsuccessful at getting them to pay the taxes and now the house is being offered up for tax sale if he doesn't get the $1200 paid. He said the money's still in escrow, but he doesn't have it if the mortgage company doesn't want to pay it out and while he's talked about getting an attorney to help with the matter, he just lost his job so he's flat broke. I was just wondering if anyone had any advice for him on how to handle this matter and get the mortgage company to pay this before he ends up losing his home.

Borrow 1200 dollars from SOMEONE (friends?) and pay his taxes, NOW.
Worry about the mortgage company later.

I'm not sure if he knows anyone that could loan him that much (that would actually give it to him). No offense, I love my brother-in-law and I really feel for what he's going through but he's not exactly the best at paying people back. If he could get the mortgage company to come through, I think would be his best back.

Based on your post, your BIL will be homeless before he gets his mortgage company to pay his taxes before the sale...

Thank you for being honest with me. While it's never what anyone "wants" to hear, it better to know the truth. Maybe he'll find someone that can help him out between now and then. I don't know much about his friends, I just know that most of the family is having problems of their own right now.

I would contact a local consumer advocate. TV News, newspaper, etc., and I would raise a stink.
I would also contact the property tax department, take them you paperwork and ask them to delay putting the property up for sheriff's sale. Many times, they will work with homeowners.

Sorry, highly disagree! Someone already in financial trouble should never use a credit card (IMO). It's like committing financial suicide!

Does Indiana sell your property at a tax sale with just this slight delinquency?

I don't think you've heard the full story from your BIL.

I know here in my county in Ohio, houses go to the tax sale after there are so many missed payments, not by the dollar amount owed. So if someones taxes were cheap (and I think Indiana's tax's are pretty low), they could miss several payments and have their house go to auction for only $1200.

That being said, there are probably lots of other financial issues BIL has. Notice the OP isn't lending him the money!!!

I know IL does not linger with back taxes. In my county taxes are due May 1 and Sept 1, and if unsettled in Oct. they get notification of tax sale to be auctioned off in late Oct/early Nov. if not paid by then. Although, there is a 2 yr redemption period to pay tax and interest.

I became aware of that when both the title company and my mortgage company failed to pay taxes on part of my double lot (even though everything was correct on all paperwork). While I was able to get the money from the title company for first installment, my mortgage company tax dept. was unreachable, so I had to pay that out of my pocket until I could get my escrow squared away (a long story).

I am somewhat amazed when I hear of people who have not paid property taxes in some states for over 10 yrs (why would they let things slide that long?).
