I've recently closed on a house in AZ. After the loan was funded and the deed filed, I have been informed that the bank failed to include the origination fee in my closing costs. This fee was to be paid by the bank to the mortgage broker.

Am I still responsible for this fee ? or since they bank and mortgage broker failed to verify the documents prior to closing is it their loss

My understanding is that since the docs have been signed and the loan funded - then I am not responsible to pay for their mistake.

Go back to your original documents to see if they mentioned that an origination fee would be included. If so, they will argue that you "should have known". But I would still play dumb and say that the contract is signed and you reviewed it and they should have, too.
