What is the name of your state (only U.S. law)? Michigan
My daughter and her ex fiance are selling their house. They are both on title and mortgage and she is living in the house and paying the mortgage payments until it is sold. Can she legally recover from ex fiance 1/2 of the mortgage payments she has paid. Can this be taken out of proceeds from the sale of the property? He has not paid anything since he moved out and has no contact with her.
Do we need legal document stating he is not living at the premises to prove this?
Thanks,
Ellen
