What is the name of your state? michigan

i want to sell my home and called for a payoff i was told there is a 20 % penalty for paying it off early I asked in these tough times wouldn't you be happy with the money owed instead of having another home you are stuck with ???? I am postive i can sell it for what i owe on it but if you add on the penalty then it makes it a little unreasonable asking price i inquired about them waiving the fee i was told no they will send me a letter in
1-2 weeks to tell me that officially i then asked could it be lowered i was again told no and she would also send me another letter after that request go's to reivew board but she said she already new they would say no they say no to everyone..... any suggestions or help would be appreciated thank you

Read through the loan documents that you signed at closing. If there is information in there about a pre-payment penalty. then there is not much you can do.

To be sure the information you were given over the phone is correct, you should make your request in writing and get the company's answer in writing. The same goes with the request for waiving the pre-penalty fee.

Yes, these are tought times but, they are also tought times for the lender.

20% HOLY CRAP! I've heard of 2-3% penalty if refinancing within 1-3 years, but never 20%, and never for selling! Sounds ridiculous to me! I'd read my documents. If you can't sell it w/o the penalty, consider renting it out. Seems like a 20% penalty would be some sort of predatory lending, if you ask me.

OP, please post back once you find out for sure.

Thanks for the responses I just went through the paperwork and it is marked on there
Prepayment: If you prepay this loan in full or part you may have to pay a penalty i could find nothing in the paperwork that refers to any % amount. so it looks like right now they can charge what ever they want or charge nothing and they chose to charge an outrageous amount. Based on they told me they would not waive or lower the fee Iwill contact an real estate attorney and keep you posted. something for you other folks looking to get your next mortgage watch for this make sure there is no penalty like this as it can quickly suck up all you equity and still cost you **************...like me you never know what can happen that can change your situation and you may have to sell. And I am sure like most people you don't read every sheet they put in front of you and you sign sign sign i just counted there are 68 sheets not that I had to sign all that but nobody reads every sheet. When I do sell this and I go for my next mortgage they are going to hate me**************..they better get in there early because it will be an all day affair**************... I think I will take a lunch maybe pack a small dinner so i have something to eat while I am there ALL DAY

I had called an attorney and recieved a call back shortly after the last post. He said absouletly not!!!!!!! can they charge 20% he said typically it is 1-3 %. He said he is also very familiar with my mortgage company and it just doesn't sound right. And wants me to call him back when i get the letters( the ones the mortgage company is sending saying they won't waive or lower the 20% amount) He figured out based on what i owe and the highest of penalty(3%) and said if it was more than the amount given me give him back a call and also asked me if i had a prepayment disclosure form no there is not one and he said oh gezze that is a whole nother problem they can be in very serious trouble I told him if the penalty is as he stated i can live with that....I don't have a problem with them making a couple of dollars ... and I wouldn't want to pursue the other form not in there as long as i can sell with the much more smaller penaltyand no hassles. I hope my posting helps others in the same situation and can learn from all of us on here. Thank You Free advice.
I will post after the mortgage company sends those letters and let you know what they say.

The exact penalty should be listed on the documents.

I promised to get back to every one with the follow up so here it is. Dec 22 2006

The mortgage company did not send out the paperwork as they promised. So I called, I swear no one there knows there head from a hole in the ground.

On Dec 5 talked to airhead #1 says 20% penalty asked for a wavier said she would submitt my request and mail it out along with the fee I will also have to pay 30.00 for the information upon sell of the house and will have info in 5-7 business days

Dec 7 called attorney he said they cannot charge 20% the max they can charge is 3% keep him posted and do i have a prepayment fee addendum no i don't 68 pages of paperwork and no addendum**************..

Dec 12 Airhead #2 I ask how the paperwork is coming and please fax I give her fax number airhead 2 says can't find a document will get the paperwork on dec 19th they have not completed the paperwork yet but they recieved what they needed yesterday(dec 11) some kind of addendum hmmmmmmm is this the same addendum i dont have the attorney says i should????? then she had to go double check something and woulf be right back comes back on line a few minutes later they have to scan and do some figuring and figurine out the penalty that will take time she didn't know how much

Dec 18 I try to call the same customer service number i have been calling and 7x the automated service tells me my account number is not valid hmmmmmmmmm have i been blocked from calling in???????

Dec 18 Airhead #3 after 3x trying( still wont accept my account Number) to get through a person finally airhead 3# comes on then he disconnects me

Dec18 I call my sister and have her call them I swear I tell her they are blocking me from calling she calls and gets through the first time then tell thems to wait i have some one on the other line who wants to talk to you this now brings in airhead #4
I inquire you do have my fax number to fax info to me on the 19th as promised he says no it doesn't show on the screen i ask can you please make sure they get it so the info so it can be faxed and not mailed he says he CANNOT be cause those people who send out the paperwork don't have phones HMMMMMMMM am I stupid or what they don't have phones and I am to beleve that ok lets move on.... but he does proceed to tell me I now have to pay for them to research this it is called a research penalty Oh my god give me a break already .He absoulutely cannot have this faxed and i should get this in 5-7 days then he disconnects******************************************

Dec 18 I call back and get airhead #5 Please explain why this cannot be faxed he said they can't I ask why was that an option when i first called and gave a fax number but now you can't he had no answer

Dec22 I recieved the addendum******************************************.. It has my signature on it but i don't have that in my 68 pages of paperwork the penalty is 1% Yep all that sh-t and they just couldn't tell me over the phone it is 1% and not the 20% I was orginally told. I have learned alot going through this and hope this additional info can help some one else out there. good luck everyone
