What is the name of your state?OR
we will be filing for chapter 7 either this week or next week. We had a meeting with our lawyer on thursday and he told us that the mortgage company may not withdraw money from our bank for a couple of months (we have automatic payments) and we have to keep our payments current. I would like to pay the 2nd mortgage 2 months payments (May and June) will it be okay for me to call them and that I am doing this and why I am doing this, so that they will not withdraw money from the bank. We are not going to have any money left in our bank account and I don't want our bank account to be overdrawn. The 2nd mortgage insists on auto payment.
I have learnt so much from this website that so far we have not made any mistakes. And Ladynred you have been a great help to many. Thanks

You can tell them, but they may be prompted to withdraw the money out BEFORE you file. AFTER you file and they are notified, they are not ALLOWED to do ANYTHING to collect monies from you, including automatic payments.

You do NOT have to pre-pay, you can and should keep up your payments, but you'll probably have to go thru their bankruptcy dept (most have special processing for people in BK) and you'll have to MAIL them a check or money order. Once you DO file and have a case number, they have no choice BUT to accept a check for payment.
